I disagree. Since the Spanish sentence doesn’t have an explicit subject, it’s obviously referring to context, maybe the question “¿Tom está en casa?”. We don’t have that context, so it’s reasonable for the translator to make a guess of the gender, rather than come up with something that sound odd to many people.
In real life, would anyone answer the question “Is Tom at home?” with “They aren’t at home now”?
